An Act to make provision for the control of maize milling and matters incidental thereto.
[Date of Commencement: 26th April, 1961]
This Act may be cited as the Control of Maize Milling Act.
In this Act, unless the context otherwise requires—
“maize” means the grain derived from mealies.
3. Control of maize milling and purchasing
(1) No person other than a holder of a commercial miller’s licence or a restricted miller’s licence issued under this Act shall carry on the business of milling maize for other persons for reward whether in money or otherwise.
(2) No person other than a holder of a commercial miller’s licence issued under this Act shall carry on the business of purchasing maize or mealies for the purpose of milling maize to be sold by himself.
(3) Any person who contravenes the provisions of this section shall be guilty of an offence and liable to a fine not exceeding P100 or to imprisonment for a term not exceeding three months, or to both.
(1) The Minister in his discretion and on payment of the fees prescribed in the Schedule, may issue the licences referred to in section 3.
(2) A separate licence shall be required in respect of each separate premises at which any such business is carried on.
(3) The Minister may, in the exercise of his discretion under this section, take into account the need to limit the number of licences in pursuance of any scheme adopted by the Government for the development of the mealie industry and the control of maize milling in Botswana.
(4) All licences issued in terms of this Act shall expire on 31st December of the year of issue.
