An Act to make provision for the control of exports of Hides and Skins.

[Date of Commencement: 1st April, 1939]

1.    Short title

    This Act may be cited as the Hides and Skins Export Act.

2.    Interpretation

    In this Act, unless the context otherwise requires—

    “calf skin” means the skin, or part thereof, of a calf;

    “hide” means the hide, or part thereof, of a bull, cow, ox or heifer;

    “skin” means the skin, or part thereof, of a sheep or goat.

3.    Export of hides and skins prohibited except under permit

    No person shall export or cause to be exported, either by rail, road or otherwise, from Botswana any calf skin, hide or skin except under a permit issued by the District Commissioner of the district from which such calf skin, hide or skin is to be exported or by a Government Veterinary Officer, Stock Inspector or some other official authorised thereto by the President by notice published in the Gazette.

4.    Export duty to be paid

    (1) Export duty shall be payable on all calf-skins, hides or skins exported from Botswana at the rates set out in the Schedule.

    (2) Such duty shall be paid by the person applying for an export permit under section 3, to the District Commissioner, or other official to whom application for the permit is made, before the permit is issued.

    (3) The President may from time to time by order published in the Gazette make such alterations to any of the rates set out in the Schedule as he may deem necessary to maintain the export duty payable in respect of the calf-skins, hides or skins, as the case may be, to which that rate relates, at or approximating to eight percent of the average export selling price thereof.

5.    Power to make regulations

    (1) The President may make regulations for all or any of the following purposes—

    (a)    providing for the grading, marking and packing of calf-skins, hides and skins for export;

    (b)    providing for the payment of a bounty or bounties in respect of certain calf-skins, hides or skins, for the rate and calculation of any such bounty, and for the grading of such calf-skins, hides or skins for bounty purposes;

    (c)    providing for the more efficient control of the production or export of calf-skins, hides or skins, and for regulating or prohibiting the export of certain types or grades of inferior, damaged or diseased calf-skins, hides or skins, and generally for giving effect to and carrying out the objects of this Act;

    (d)    providing for the issue of licences to various classes of persons dealing in or treating calf-skins, hides and skins, and the rates of fees to be paid in respect thereof.

    (2) The President may by such regulations prescribe penalties for any contravention thereof:

    Provided that no such penalty shall exceed a fine of P400 and imprisonment for two years.

6.    Production of hides and skins before issue of export permit

    Every person making application for an export permit under section 3 shall, if required, produce to the District Commissioner or other official issuing the permit the calf skins, hides or skins which he desires to be exported for the purpose of calculation of export duty or shall otherwise satisfy the District Commissioner or such official regarding the calculation of such duty.

7.    Penalties

    Any person who contravenes the provisions of section 3 shall be guilty of an offence and liable to a fine not exceeding P400 or to imprisonment for a term not exceeding two years, or to both; and in addition to such penalty the court may order that all or any calf skins, hides or skins in respect of which such contravention has occurred be forfeited to the Government, whereupon such calf skins, hides or skins shall be disposed of in accordance with directions issued by the Director of Veterinary Services.

The rates of export duty shall be—
