An Act to re-enact with amendments the National Assembly (Salaries and Allowances) Act.

1.    Short title

    This Act may be cited as the National Assembly (Salaries and Allowances) Act.

2.    Interpretation

    In this Act, unless the context otherwise requires-

    “Assembly” means the National Assembly;

    “Leader of the Opposition” means the person designated by the Speaker of the Assembly as Leader of the Opposition;

    “Member” has the meaning assigned to it under section 58 of the Constitution.

3.    Salaries and allowances of Speaker and Deputy Speaker

    (1) The Speaker and Deputy Speaker of the Assembly shall each be paid, from moneys appropriated by law for such purpose, the appropriate salary payable in terms of section 4.

    (2) The Speaker and Deputy Speaker shall, in addition, receive the allowances specified in paragraphs 3 and 8 of the Schedule and shall be eligible to receive—

    (a)    for the Speaker, the allowance specified under paragraph 2(2) of the Schedule; and

    (b)    for the Deputy Speaker, the allowance payable under paragraph 2(3) of the Schedule

4.    Salaries and allowances of Members

    (1) Members shall be paid, from moneys appropriated by law for such purpose, the salaries and allowances prescribed in the Schedule.

    (2) The Speaker, Deputy Speaker and each Member shall be deemed to have had incorporated into their basic salary, prescribed in the Schedule and payable over the Session of Parliament whose life commenced on the 16th October, 1999, a car subsidy allowance amounting to P120,000.

5.    Allowances exempt from income tax

    The allowances payable or benefits granted in terms of this Act shall be exempt from income tax.

6.    Saving in respect of other allowances

    Nothing in this Act shall be deemed to prohibit the payment to any Member of any subsistence or other allowance in respect of the performance by him of duties as a Minister or Assistant Minister, or as a Member of any board or committee appointed to advise any Minister, or for any other purpose.

1.    Salary

    (1)Every Member, shall receive a salary which shall, except in the case of the Government Whip and the Opposition Whip, include the responsibility allowance, calculated, in case of—

    (a)     the President, at the rate of P1 325,108.70 per annum;

    (b)    the Vice President, at the rate of P1 162,376.50 per annum;

    (c)    the Speaker, at the rate of P1 027,998.99 per annum;

    (d)    a Minister, other than an Assistant Minister, at the rate of P893,621.49 per annum;

    (e)    an Assistant Minister, at the rate of P687,640.10 per annum;

    (f)    the Deputy Speaker, at the rate of P790,630.86 per annum;

    (g)    the Leader of the Opposition, at the rate of P790,630.86 per annum;

    (h)    the Government Whip, at the rate of P579,753.50 per annum;

    (i)    the Opposition Whip, at the rate of P579,753.50 per annum; and

    (j)    any other Member, at the rate of P579,753.50 per annum.

2.    Sitting allowance

    (1) Every Member, who attends a meeting of the Assembly or of a committee of the Assembly shall receive an allowance at the rate of P517.02 for every day on which he or she attends such a meeting.

    (2) The Speaker shall receive an allowance at the rate of P630.00 for every day on which he or she attends a meeting of the Assembly or of a committee of the Assembly.

    (3) The Deputy Speaker shall receive an allowance at the rate of P525.00 for every day on which he or she attends a meeting of the Assembly or of a committee of the Assembly.

3.    Transport allowance

    (1) Every Member, other than a Minister and Assistant Minister shall receive an allowance, calculated in accordance with the provisions of subparagraph (2), in respect of one return journey undertaken by him or her by the shortest convenient route in his or her own motor vehicle or by a public road, rail or air service-

    (a)    from his or her home to any meeting of the Assembly, or to any committee thereof of which he or she is a Member held while the Assembly is not sitting; and

    (b)    from any such meeting to his or her home during any adjournment of such meeting of three clear days or longer.

    (2) Such allowance shall be-

    (a)    where the journey or any part thereof is undertaken in the Member’s own vehicle, at the rate for the time being applicable to public officers; and

    (b)    where the journey or any part thereof is undertaken by any public road, rail or air service, a sum equal to the fare actually paid up to a maximum of the ordinary first class fare payable on such service.

4.    Constituency allowance

    Every Member, shall receive an allowance calculated as follows—

    (a)    for a Member representing one of the following constituencies—

        Boteti East

        Boteti West

        Chobe

        Ghanzi North

        Ghanzi South

        Jwaneng – Mabutsane

        Kgalagadi North

        Kgalagadi South

        Letlhakeng – Lephephe

        Maun East

        Nata – Gweta

        Ngami

        Okavango

        Takatokwane

        at the rate of P221,470.70 per annum;

    (b)    for a Member representing one of the following constituencies—

        Bobonong

        Goodhope – Mabule

        Kanye South

        Lentsweletau – Mmopane

        Lerala – Maunatlala

        Mahalapye East

        Maun West

        Mmadinare

        Mmathethe – Molapowabojang

        Mochudi East

        Mochudi West

        Maun East

        Moshupa – Manyana

        Nkgange

        Sefhare – Ramokgonami

        Serowe North

    (c)    for a Member representing one of the following constituencies—

    (d)    for a Specially Elected Member and the Speaker of the National Assembly, at the rate of P180,428.98 per annum; and

    (e)    for the President, at the rate of P232,544.16 per annum.

5.    Acting allowance

    Every Member shall receive an acting allowance of P79.24 for every sitting of the Assembly during the whole or part of which he or she presides in place of the Speaker or the Deputy Speaker.

6.    Hospitality allowance

    (1) Every Member (other than the Vice-President, a Minister, the Speaker, an Assistant Minister, the Deputy Speaker and the Leader of the Opposition) shall receive a hospitality allowance at the rate of P9,947.70 per annum.

    (2) Every Member (other than the Vice-President, a Minister, the Speaker, an Assistant Minister, the Deputy Speaker and the Leader of the Opposition) shall when he or she is necessarily absent from Botswana attending a conference, seminar or similar function approved by the President, receive a hospitality allowance of P284.29 together with subsistence allowance at the rates payable to public officers for every day or part thereof.

    (3) The following members shall receive the following hospitality allowances—

    (a)    Vice-President, at the rate of P14,330.36 per annum;

    (b)    a Minister, at the rate of P20,739.60 per annum;

    (c)    the Speaker, at the rate of P20,739.60 per annum;

    (d)    an Assistant Minister, at the rate of P20,739.60 per annum;

    (e)    the Deputy Speaker, at the rate of P20,739.60 per annum;

    (f)    the Leader of the Opposition, at the rate of P11,264.40 per annum;

7.    Allowance for Chairman of Parliamentary Committee

    The Chairman of a Parliamentary Committee shall receive an allowance of P546.00 per day for every day on which the Committee sits which is not a day on which the National Assembly is sitting.

8.    Allowance for Vice-President, Ministers and Assistant Ministers

    The Vice-President, Ministers and Assistant Ministers shall receive housing, transport, garden and water allowances and such other benefits as the President may from time to time determine.

9.    Other allowances for Speaker, etc.

    The Speaker, Leader of the Opposition and Deputy Speaker shall receive housing, transport, garden and water allowances at such rates as may be applicable to Ministers and Assistant Ministers from time to time in accordance with paragraph 8.

10.    Communication allowance

    Every Member shall receive a communication allowance at the rate of P41,762.45 per annum.

11.    Car allowance

    Every Member shall (other than the Vice-President, a Minister, the Speaker, an Assistant Minister, the Deputy Speaker and the Leader of the Opposition) who is not provided with an official vehicle shall receive a car allowance at the rate of 10 per cent of his or her salary.
